Introduction

This purchase is governed by the following standard terms and conditions for consumer purchases of goods over the Internet.

Online consumer purchases are primarily regulated by the Norwegian Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Right of Withdrawal Act, and the E-commerce Act. These laws grant consumers mandatory rights that cannot be waived. The laws are available at www.lovdata.no.

These terms shall not be interpreted as limiting statutory rights, but rather define the main rights and obligations of both parties.

The terms and conditions are prepared and recommended by the Norwegian Consumer Authority (Forbrukertilsynet). For further guidance, please refer to their official guidelines.


1. The Agreement

The agreement consists of these terms and conditions, information provided in the ordering solution, and any separately agreed terms.

In case of conflict, specifically agreed terms between the parties prevail, provided they do not conflict with mandatory legislation.

The agreement is also supplemented by relevant legal provisions governing consumer purchases.

Referred to as “the seller”.

Buyer:
The consumer placing the order, referred to as “the buyer”.


3. Price

All prices are stated in NOK.

The stated price includes all taxes and additional costs. The buyer shall not bear any additional costs not disclosed prior to purchase.

The seller reserves the right to adjust prices due to changes from partners. In cases of pricing errors exceeding 15%, the seller may correct the price or cancel the order.

Price changes after order placement (not due to errors) do not apply retroactively.


4. Conclusion of Agreement

The agreement becomes binding when the buyer submits the order.

However, the agreement is not binding if there are obvious errors (e.g., pricing or typing mistakes) that the other party reasonably should have understood.

The seller reserves the right to cancel orders if products are out of stock or incompatible. The buyer will be notified and offered alternatives.

Orders intended for resale may be canceled.


5. Payment

Accepted payment methods will be clearly stated before checkout.

The seller may reserve the amount until shipment. If charged before shipment, it is considered prepayment.

Prepayment may only be required where justified (e.g., custom production).


Purchases by minors

Minors may purchase goods if they control the funds themselves.

Buyers under 18 cannot pay via invoice, as this would create debt, which is prohibited under Norwegian law.


6. Delivery

The buyer will be informed of delivery options and timelines before purchase.

Delivery occurs when the buyer (or a designated person) has taken possession of the item.

Delivery is considered completed when:

  • The item is delivered to the buyer
  • Placed in the mailbox
  • Delivered to an agreed location (e.g., workplace, neighbor)

Delivery is not complete when the item is at a pickup point until it is collected.


7. Risk of the Goods

Risk transfers to the buyer upon delivery.

If the item is lost or damaged before delivery, the seller bears the risk. After delivery, the buyer bears the risk.

If the buyer selects their own carrier, risk transfers when that carrier receives the goods.


8. Right of Withdrawal

The buyer has a 14-day right of withdrawal.

The buyer must notify the seller in writing (email or letter) within 14 days of receiving the item.

Returns must be agreed with the seller and sent within a reasonable time in original packaging.

The buyer is responsible for return shipping costs.

Refunds (including original shipping costs) will be issued within 14 days after the seller receives the returned product.


Exceptions

The right of withdrawal does not apply to goods that deteriorate quickly (e.g., fresh food).


9. Buyer’s Rights and Complaints

Defects

The buyer must notify the seller within a reasonable time after discovering a defect.

Complaints made within 2 months are always considered timely.

  • Standard complaint period: 2 years
  • Extended: 5 years for long-lasting goods

Remedies

If a defect exists, the buyer may:

  • Withhold payment
  • Request repair or replacement
  • Request a price reduction
  • Cancel the purchase
  • Claim compensation

Delay or non-delivery

If delivery is delayed:

  • Buyer may demand fulfillment
  • Set a deadline
  • Cancel the purchase
  • Claim compensation

10. Seller’s Rights

If the buyer fails to pay:

  • Seller may withhold goods
  • Demand payment
  • Cancel the agreement
  • Charge interest and fees

Unclaimed goods may incur a fee (not applicable to minors).

The seller retains ownership until full payment is made.


11. Warranty

Any warranty provided is in addition to statutory rights and does not limit the buyer’s rights under law.


12. Personal Data

The seller is responsible for personal data processing.

Data is only collected and stored as necessary to fulfill the agreement and comply with legal obligations.


13. Disputes

The parties shall attempt to resolve disputes amicably.

If unresolved, the buyer may contact the Norwegian Consumer Council (Forbrukerrådet).

All disputes are governed by Norwegian law and handled in the buyer’s jurisdiction.


14. Conflict Resolution

Complaints must be submitted within a reasonable time.
